Tom represents clients in various aspects of bankruptcy, commercial law, and creditors’ rights including secured lending transactions, preference and fraudulent transfer actions, mortgage foreclosures, enforcement of judgments, contract litigation, collection matters, commercial lien disputes and general corporate transactions. Tom is a member of the Bankruptcy and Creditors’ Rights and Litigation Groups.

  • Represents secured and unsecured creditors in complex restructuring workouts and bankruptcy matters. Bankruptcy experience includes successfully defending creditors in preference and fraudulent transfer litigation, drafting reorganization plans, creditor committee representation, negotiating and advising clients on executory contract and lease assumption issues, selling bankruptcy claims, and enforcement of reclamation rights and related litigation.
  • Extensive experience in general commercial contract negotiations and drafting, including supply contracts, equipment leases, and asset purchase agreements.
  • Represents several lending institutions in structuring, negotiating and documenting multi-million dollar secured credit transactions. Counsels suppliers, senior and junior lenders in complex subordination, intercreditor and guaranty transactions, including negotiating and drafting operative documents.
  • Successfully conducts real estate foreclosure sales and other judgment executions and collection actions.
  • Represents both buyers and sellers of assets in distressed liquidation sales under Article 9 of the Uniform Commercial Code and the Bankruptcy Code.
