A partner of the firm’s Data Security and Insurance Recovery Practice Groups, Roberta concentrates her practice in the areas of insurance coverage litigation and counseling and emerging cybersecurity and data privacy-related issues, including security incident planning and breach response.

For nearly two decades, Roberta has represented clients in connection with a broad spectrum of insurance issues arising under almost every kind of business insurance policy. In addition to helping clients successfully pursue contested insurance claims, Roberta counsels clients proactively on complex underwriting and risk management issues. She has extensive experience in the selection, drafting, negotiation, and placement of cybersecurity and data privacy insurance, directors and officers liability insurance, professional liability insurance, and many other types of insurance coverages. Roberta correspondingly provides strategic advice on ways in which her clients can best maximize the value of their current and historic insurance assets.

Roberta has particularized, unique, and extensive experience with cybersecurity and data privacy-related insurance coverages. She routinely advises clients in assessing their potential security and data privacy risks, in analyzing the adequacy of their existing insurance programs to address those risks, and in selecting and negotiating new and renewal insurance placements tailored to the client’s specific risk profile.

A recognized national authority in insurance coverage, cybersecurity, and data privacy-related issues, Roberta frequently lectures on these subjects, including for the American Bar Association, the Risk and Insurance Management Society, the Professional Liability Underwriting Society, the Pennsylvania Bar Association, the Practicing Law Institute, Strafford Continuing Legal Education, and Law Seminars International. Among her other presentations, she is honored to have been selected to present on the fundamentals of, and cutting edge developments in, cybersecurity and data privacy-related insurance for the past three years at the RIMS Annual Conference.

Roberta regularly provides interviews and comments on cybersecurity and data privacy-related issues to leading industry publications, such as Law360 and Advisen, and to national mainstream publications, such as The New York Times and The Washington Post.

Roberta has published over 100 articles in professional journals and academic law reviews on cybersecurity and data privacy-related insurance and a variety of other subjects. She is delighted to have recently co-authored the new cybersecurity guide for executives, Navigating the Digital Age: The Definitive Cybersecurity Guide For Directors and Officers.

Roberta counsels clients on numerous complex underwriting and risk management issues and recently served as insurance coverage counsel in connection with one of the largest data breaches to date.

Roberta has represented clients in connection with a broad spectrum of insurance disputes arising under almost every kind of business insurance policy.

Her representative matters include:

  • Served as lead trial counsel in a precedent-setting victory on behalf of the policyholder in a landmark decision concerning CGL insurance coverage for losses caused by a mechanical equipment failure.
  • Briefed a precedent-setting victory on behalf of the policyholder in a landmark decision concerning insurance coverage for claims alleging injuries resulting from exposure to radioactive emissions.
  • Successfully represented a worldwide oil and gas exploration and production company in a case regarding recovery under Bermuda Form policies for class action litigation alleging Hurricane Katrina-related property damage.
  • Successfully represented one of the four largest U.S. bank holding companies regarding recovery under its financial institution bonds/fidelity policies in connection with a substantial employee theft loss.
  • Successfully represented one of the largest U.S. diversified financial institutions regarding recovery under its vehicle residual value insurance policy. The case settled favorably on the eve of trial for a mid-nine figure recovery.
  • Successfully represented one of the world’s three largest producers of aluminum regarding recovery under its general liability insurance policies in connection with underlying claims alleging property damage to boats and other seafaring vessels arising out of the distribution of an aluminum alloy.
  • Successfully represented a provider of health benefit plans regarding recovery under its excess loss mitigation insurance policies in connection with the settlement of underlying securities class action lawsuits.
  • Successfully represented an energy sector policyholder regarding recovery under its pollution insurance policy in connection with the remediation of a former nuclear fuel processing facility.
  • Successfully represented a private equity investment firm regarding recovery under its professional liability insurance policy in connection with underlying litigation alleging breach of a merger agreement.
  • Successfully represented a group self-insurance fund policyholder regarding recovery under its crime/fiduciary policy in connection with a substantial employee theft loss.

Insurance Coverage Due Diligence:

Roberta has performed insurance due diligence for clients contemplating mergers and acquisitions concerning the adequacy of the target companies’ insurance programs.

Her representative matters include:

  • Counseled an energy sector client in assessing the adequacy of key coverage terms and conditions, including sufficiency of limits, of a target company’s nuclear liability, pollution legal liability, CGL, and property insurance policies prior to acquisition.
  • Counseled a nonprofit client in assessing key coverage terms and conditions of a target’s CGL, D&O, E&O, professional liability, and workers’ compensation/employers’ liability policies prior to merger.

Roberta currently serves as Vice-Chair for the American Bar Association (ABA) Tort and Insurance Practice Section (TIPS) Cybersecurity and Data Privacy General Committee, Vice-Chair for the ABA Insurance Coverage Litigation General Committee, Co-Chair of the ABA Section of Litigation’s Insurance Coverage Litigation Committee’s Cyber Risk & Data Privacy Subcommittee, and on the ABA TIPS Cybersecurity Task Force.
