Litigation and Arbitration
The Cohen & Grigsby Construction Team has significant experience representing owners, contractors and design professionals in multi-week trials and arbitrations. We have significant first chair trial experience in a wide array of venues (jury trials, bench trials, trials before various boards of claim and environmental hearing boards, and both single and three panel arbitrations under the AAA and JAMS/Endispute Rules) and on appeal.
Drafting & Negotiating Construction Contracts
Cohen & Grigsby’s Construction Team counsels clients in the development and negotiation of construction contracts and subcontracts as well as contracts for architectural services and other consultant contracts. Our team members are well versed in the AIA, DBIA, EJCDC, and ConsensusDocs forms. Our seasoned litigators are able to use their experience on the front end of projects to prevent disputes and contain risk along the way.

- Owner’s representative, architect (AIA B133), and construction manager (GMP using AIA A133/A201) contracts for the construction of a new theater.
- General contractor (GMP using AIA A102 and A201) for office build out.
- Fine-tuning of form contracts for commercial real estate management company, including AIA A101; A102; A201; A104; B101; and B104.
- Creation of a suite of custom contracts tailored to applicable state laws, including consumer construction and subcontractor agreements for national restoration services company.

Land Use, Zoning and Regulatory Compliance
Our diverse team of experienced attorneys partners with public and private-sector clients to identify, address and solve the comprehensive range of zoning, land use, environmental and governmental challenges impacting their development projects. We work on a full range of commercial, residential, mixed- and adaptive-use developments, including offices, shopping centers and retail projects, hotels and condominiums, telecommunications facilities, landfills and waste-to-energy facilities, oil and gas operations, warehouses and other industrial developments. Our lawyers advise on zoning, site planning, permitting and subdivision matters, providing knowledgeable counsel on the feasibly of clients’ projects and practical, business-focused solutions to problems that might impede their success. We guide clients through the complex patchwork of municipal regulations and prepare effective applications to secure permits, approvals and waivers.
If necessary, we can immediately react to unannounced inspections from any governmental regulator, including EPA, DEP, and OSHA. When required, we advocate on behalf of clients before zoning boards and planning commissions, historic and landmarks commissions, and other municipal and state regulatory agencies, as well as in appeals.
