On November 18, 2015 in the Common Pleas Court of Butler County, Ohio, a jury rendered a unanimous multi-million dollar verdict in Clarkwestern Dietrich Building Systems’ favor, finding that the Certified Steel Stud Association (CSSA) made false and misleading statements in commercial advertising regarding ClarkDietrich and its steel framing products and otherwise engaged in unfair competition.
On October 8, 2013, ClarkDietrich Building Systems, LLC., (“ClarkDietrich:) brought an action in the Court of Common Pleas of Butler County, Ohio, against several of its largest competitors, including Ware Industries, Inc. and California Expanded Metals Company, as well as the CSSA, which is a trade association formed by those companies. In its complaint, ClarkDietrich alleged that the defendants conspired to disparage ClarkDietrich’s products and to engage in unfair competition designed to harm ClarkDietrich. After a nearly 11 week trial that began in September, the Ohio jury unanimously ruled in favor of ClarkDietrich by awarding it $49.5 million in compensatory damages.
