OSHA Litigation

Cohen & Grigsby’s Litigation Practice includes representing companies in matters arising under the Occupational Safety and Health Act of 1970 (OSHA).  Our OSHA attorneys have handled and tried several important OSHA cases throughout the United States, including cases for general contractors and subcontractors, equipment leasing companies, steel erectors, and others involved in fatalities and serious construction accidents.  We also have experience with OSHA matters for companies in general industry, including manufacturers, engineering firms, restaurants, and hospitals.

• Counseling clients in responding to requests for information from OSHA concerning employee complaints about safety and health
• Advising clients on handling OSHA inspections, including whether to resist the inspection and compel OSHA to obtain a warrant
• Counseling clients on proper procedures to utilize during OSHA inspections
• Reviewing and investigating citations issued by OSHA, MHSA and state occupational safety and health agencies
• Representing clients at informal settlement conferences held by OSHA Area Directors and negotiating settlement agreements
• Litigating occupational safety and health complaints before federal and state courts, the Occupational Safety and Health Review Commission and administrative law judges
• Negotiating settlements of contested administrative litigation matters
• Handling cases on appeal to the Occupational Safety and Health Review Commission and to the Court of Appeals
• Conducting compliance audits and advising companies regarding compliance and implementation of occupational safety and health programs
• Developing and implementing companies’ OSHA strategies
