Cohen & Grigsby’s Intellectual Property Practice Group counsels clients on establishing, protecting, transferring and enforcing patents, trademarks, trade names, trade dress, copyrights, service marks, trade secrets, and other areas of intellectual property rights in both the United States and internationally.

A substantial part of our practice is related to patent prosecution and infringement issues.  We also advise clients on protection available for their technology including software, electronics, bio and medical related appliances, chemical processes and products, and general mechanical and process apparatus.

Our capabilities encompass advising domestic and international clients on protection of trade secrets, proprietary information, copyrights, trade names, trademarks, patents, licensing, technology transfer and non disclosure and non compete agreements.  Related areas of practice include advertising, compliance, unfair competition and rights of publicity or privacy, and patent litigation.

We represent a variety of companies and individuals, including high technology, biotechnology, software, medical, manufacturing, service and other industries.

  • Preparing, prosecuting and maintaining patent and trademark applications with the U.S. Patent and Trademark Office and international Patent and Trademark offices
  • Prosecuting and maintaining information and copyrights
  • Protecting trade secrets and confidential technology
  • Conducting searches to determine priority and availability of patents and trademarks and interpreting of potential conflicts or enforceability
  • Counseling on ownership and registration rights in patents, trademarks, service marks, domain names and copyrights both in the U.S. and abroad

  • Advising clients on proper use of trademarks

  • Prosecuting opposition and cancellation proceedings with the Trademark Trial and Appeal Board of the U.S. Trademark Office

  • Negotiating, preparing and recording license agreements, security interests and agreements, assignments, asset purchase agreements, concurrent use agreements and other related agreements
  • Providing due diligence services between the U.S. and worldwide in relation to acquisitions, mergers and transfer of intellectual property in general

Representative Transactions
  • Successfully enforced a chemical client’s process patents in Europe
  • Successfully asserted a claim declaring ownership rights in software programs under the federal copyright statute on behalf of a high tech company
  • Defended two high tech companies in copyright infringement claims based upon the alleged use of unlicensed software
  • Successfully represented a manufacturing company in defending against claims of copyright infringement in connection with the use of certain designs on their products
  • Obtained preliminary relief in a consumer product trademark case
