Cohen & Grigsby’s Labor and Employment Group counsels and represents employers in the full spectrum of labor, employment and human resource law.

The Labor and Employment Group includes attorneys experienced in overcoming the legal challenges presented by union activity, reengineering and downsizing, business transactions, new laws and regulations, and all varieties of labor and employee disputes.  The Group also concentrates a significant portion of its practice on helping employers avoid and defend discrimination and other employment-related legal actions.  Cohen & Grigsby lawyers are experienced in conducting labor audits, developing employment policies and practices, and training supervisors.

Over the past decade, labor and employment law has undergone more changes that directly an employer’s impact bottom line than perhaps any other legal discipline.  In addition, regulatory agencies and courts are interpreting and defining laws such as the Americans with Disabilities Act, the Fair Labor Standards Act and the Family and Medical Leave Act in ways that significantly impact employers.  The political and regulatory pendulum has begun to swing back in favor of unions.  Many organizations must downsize their workforce to remain competitive in a significantly changed and global market.  Cohen & Grigsby can help an employer address the challenges presented by these and other developments.  We strive to make our clients aware of significant developments as they occur through bulletins, newsletters and seminars.

The Group has provided legal counsel to a wide variety of employers, including unionized and non-unionized companies, manufacturers of all sizes, transportation businesses, healthcare institutions, financial companies, service businesses, and high technology firms.  Our attorneys have published extensively in national and regional industry and legal publications on virtually every labor law topic, including new laws and regulations, important court decisions, labor trends, and National Labor Relations Board (NLRB) matters.

Major Practice Concentrations
Here are some of the major practice concentrations of the Cohen & Grigsby Labor and Employment Group:  

Union Avoidance
Cohen & Grigsby has experience representing management in collective bargaining, arbitrations, union related litigation, union organizing campaigns and elections, and NLRB and other regulatory proceedings.  The Labor and Employment Group also provides counsel related to union avoidance and resistance campaigns and representation before the NLRB, OSHA, DOL, and other government agencies.  

Labor Aspects of Business Transactions
Several Cohen & Grigsby labor attorneys have concentrated a significant part of their practice on advising employers on labor and employment issues affecting business transactions such as mergers, sales, acquisitions, affiliations, relocations and plant closings.  

Employment Contracts
We have extensive experience developing employment, non-compete and termination contracts that preserve management rights, are legally defensible and protect the employer from future litigation.  

Employment Litigation Defense
Members of the Group take particular pride in the results obtained on behalf of clients in defending employee discrimination claims before federal and state agencies.  We work with clients in developing policies, practices and, in environments which tend to minimize such claims and when litigation and lawsuits cannot be avoided, ably and aggressively defend those actions in a cost-effective and businesslike manner.  

Workers’ Compensation
Our Workers’ Compensation division has experience in counseling and defending many types of employers in Workers’ Compensation litigation, and advises employers on developing transitional work and funded employment programs.  Representative cases include traumatic injuries, lower back, amputation, hearing loss, and occupational diseases.  The Workers’ Compensation division has a medical case manager who is a registered nurse.  

Avoidance of Employment- Related Legal Actions
The Labor and Employment Group provides a number of cost-effective ways to help organizations minimize liabilities associated with being an employer in a highly litigious society. The Group can help a company develop policies, job descriptions and practices that comply with all laws and regulations, minimize the likelihood of an employee lawsuit and make the workplace a less fertile ground for union activity.  

Training
We conduct supervisory and management training focused on areas such as compliance with new laws and regulations, FLSA compliance, sexual harassment, substance abuse, union resistance, and vulnerability to union organizing.
