Mr. Clutter is an associate in the Firm’s Labor & Employment Group where he concentrates his practice in representing and counseling employers in a wide range of employment-related matters. Mr. Clutter devotes a substantial portion of his practice to advising employers concerning union organizing efforts, negotiations, and contract interpretation issues. In addition, Mr. Clutter represents employers in labor arbitrations and unfair labor practice proceedings before the National Labor Relations Board. As part of his employment practice, Mr. Clutter routinely counsels employers on issues that arise every day, including hiring, disciplining and discharging employees as well as responding to employee requests for leave and accommodation. Mr. Clutter also has extensive experience defending employers in discrimination cases before federal courts and federal and state agencies.

Representative Matters- Successfully defended an employer in a discriminatory layoff case before the National Labor Relations Board where the General Counsel and the union argued that the affected employees had been targeted because of their union activities
- Obtained summary judgment in a reverse discrimination case in the U.S. District Court for the Western District of Pennsylvania where a male employee argued that he had been discharged for violating the employer’s sexual harassment policy because of his gender
- Obtained summary judgment in an Americans with Disabilities Act case in the U.S. District Court for the Western District of Pennsylvania where employee argued that several affiliated entities constituted a single employer.
